Ms. Bailey has a litigation practice that includes insurance, insurance regulatory law, employment practices, transportation liability, aviation liability and personal injury. She has extensive litigation experience handling a wide variety of cases, as well as transactional experience representing businesses and financial institutions in business transactions and employment law matters. Ms. Bailey has handled jury trials in Idaho and has handled matters on appeal before the Idaho Supreme Court, the Idaho Court of Appeals, the Nevada Supreme Court and the Ninth Circuit Court of Appeals. She advises insurance companies and related businesses concerning insurance regulatory issues. Ms. Bailey is a member of the Idaho State Bar and the Nevada State Bar. She has served as a member of the Idaho State Bar Advocate Editorial Advisory Board and the Nevada State Bar Fee Dispute Arbitration Board. She has been active in the Fourth Judicial District Court Appointed Special Advocate Program, in the Ada County Youth Court and in the Boise Senior Center Legal Clinic Program. Ms. Bailey is admitted to practice before the United States District Court for the District of Idaho and the Ninth Circuit Court of Appeals. Ms. Bailey was born in Grangeville, Idaho, and grew up in Post Falls, Idaho. In 1987 Ms. Bailey graduated from the University of Idaho with a bachelor of arts degree in journalism. She was on the Dean’s Honor List, and she served as an Associated Students of the University of Idaho Senator, Chairman of the Governing and Ordinance Committee, Member of the Academics Board, Member of the Student Alumni Relations Board, Secretary of the Political Concerns Committee and Assistant Chairman of the Rules and Regulations Committee. Ms. Bailey graduated from the University of Idaho College of Law in 1990. During law school, Ms. Bailey was on the Dean’s Honor List. She also served as Lead Articles Editor of the Idaho Law Review, and as a teaching assistant for Legal Research and Writing and Lawyering Process.
Following law school, Ms. Bailey worked for several years at a private law firm in Las Vegas, Nevada, where she represented clients in insurance defense, construction defect, commercial, business, lender liability, real estate, title insurance and employment litigation. She then returned to Idaho and worked in private practice in Boise. During her private practice in Boise, she became a shareholder in a major Boise law firm. There, Ms. Bailey continued to have a litigation practice that included insurance defense, employment practices, business and commercial litigation cases. During this time frame, Ms. Bailey’s practice included defending an aircraft manufacturer in a multimillion dollar product liability action.
In 2002, Ms. Bailey became a State of Idaho Deputy Attorney General for the Intergovernmental and Fiscal Law Division. Ms. Bailey was assigned as in house counsel to represent the State of Idaho Department of Insurance in all areas of insurance regulation, including oversight of property and casualty, life and health insurance companies, managed care organizations, health service organizations, provider networks, self-funded health care plans, multiple employer welfare arrangements, reinsurance carriers, third party administrators, brokers and producers. She worked extensively with the United States Department of Labor, Employee Benefits Security Administration, investigating a professional employer organization and a third party administrator, and participating in an ERISA class action suit filed in the federal district court of Oklahoma. Ms. Bailey also was appointed as a special assistant United States Attorney to assist in the prosecution of an Idaho insurance agent on multiple counts of felony insurance and mail fraud.
From 2005 to 2009, Ms. Bailey served as the Corporate Counsel and Idaho manager for the American Farmers and Ranchers Mutual Insurance Company, a national commercial property and casualty insurance company licensed in 24 states. Ms. Bailey supervised the Company’s legal and regulatory compliance department, and implemented and maintained the Company’s corporate compliance program. She oversaw the Company’s marketing and trade practices, and handled all multi-state regulatory filings. Ms. Bailey drafted insurance policies, endorsements, state amendatory endorsements, underwriting rules, rating manuals and rating rules. She negotiated and drafted insurance agency agreements and other contracts. Ms. Bailey directed and controlled the Company’s external relationship with 24 state departments of insurance, the National Association of Insurance Commissioners, independent agents and third party consultants, contractors and vendors.
Ms. Bailey is a senior associate attorney in the Boise office.
